Terms of Service
These Terms of Service (the "Terms") govern access to and use of the AEOLUS platform, website, APIs, and connectors (the "Service") provided by AEOLUS ("we," "us"). By creating an account or using the Service you agree to these Terms on behalf of yourself and, if applicable, the organization you represent (together, "you"). If you do not agree, do not use the Service.
1. The Service
AEOLUS is an Answer Engine Optimization (AEO) analytics platform: it measures brand visibility in AI answer engines, audits and scores web content, and produces recommendations, drafts, and reports. The Service is intended for business use.
2. Accounts and eligibility
You must be at least 16 and able to form a binding contract. You are responsible for your account credentials, for all activity under your account and API tokens, and for ensuring your team's use complies with these Terms. Notify us promptly of any suspected unauthorized access.
3. Subscriptions, pilots, and fees
- Paid plans are billed in advance, monthly or annually, per the pricing at aeolus-cloud.com. Fees are non-refundable except where required by law. Prices may change with at least 30 days' notice, effective at your next renewal.
- Pilots are invite-only, granted case-by-case, and time-limited (typically 30 days). During a pilot we may fund model/API usage up to a stated cap; we may suspend sponsored usage that exceeds the cap or appears abusive. Pilots convert to a paid plan or end at the pilot's close.
- You are responsible for taxes applicable to your purchase, other than our income taxes.
4. Your keys and third-party services (BYOK)
The Service can run analyses using API keys you supply (e.g., OpenRouter, Anthropic, OpenAI, Google, Perplexity, xAI, SerpApi). You are responsible for those accounts, their terms, and the usage costs they incur. We store supplied keys encrypted (AES-256-GCM), use them only to perform the operations you request, and never disclose them. Optional integrations (Google Search Console/GA4, Monday.com, MCP clients such as Claude) are governed by the third party's terms in addition to these Terms.
5. Acceptable use
You agree not to:
- Scan, crawl, or analyze websites or brands you do not own or lack authorization to assess where such analysis would violate applicable law or third-party rights;
- Use the Service to violate any law, infringe intellectual-property or privacy rights, or transmit malware;
- Attempt to probe, bypass, or defeat security or rate limits, or access data of another organization;
- Resell or white-label the Service except as expressly permitted by your plan;
- Use the Service to build a directly competing product, or reverse engineer it except where the law permits notwithstanding this clause.
We may throttle, suspend, or terminate access for violations, with notice where practicable.
6. Your content and our license
You retain all rights to content you submit and to your scan results ("Customer Data"). You grant us a limited, non-exclusive license to host and process Customer Data solely to provide the Service. You represent that you have the rights needed to submit the content you analyze. We do not use Customer Data to train AI models.
7. AI output disclaimer
The Service uses large language models and probabilistic sampling. Findings, scores, brand-claim audits, rewrites, and recommendations may be incomplete or inaccurate, and visibility metrics carry statistical variance. Outputs are provided for informational purposes and are not professional advice. Review outputs — especially public-facing statements and factual claims — before acting on them.
8. Intellectual property
We own the Service, including software, methodology, design, and trademarks (including "AEOLUS" and the wind-glyph mark). White-label features grant you the right to present reports under your brand while you maintain an eligible subscription; they do not transfer ownership.
9. Confidentiality and data protection
Each party will protect the other's non-public information with reasonable care and use it only as needed to perform under these Terms. Our data practices are described in the Privacy Policy; a Data Processing Addendum is available on request.
10. Termination
You may cancel at any time, effective at the end of the current billing period. We may suspend or terminate for material breach (with 14 days' cure notice where curable) or for unlawful use. Upon termination we will make Customer Data available for export for 30 days, then delete it per the Privacy Policy. Sections 6–13 survive termination.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUES. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. THESE LIMITS DO NOT APPLY TO YOUR PAYMENT OBLIGATIONS, EITHER PARTY'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR YOUR BREACH OF SECTION 5.
13. Indemnification
You will defend and indemnify us against third-party claims arising from your Customer Data, your use of the Service in violation of these Terms, or your analysis of websites/brands without necessary rights or authorization.
14. General
These Terms are governed by the laws of the State of [Delaware], excluding conflict-of-law rules; exclusive venue lies in its state and federal courts. We may update these Terms with at least 14 days' notice for material changes (posted here and dated); continued use after the effective date is acceptance. If a provision is unenforceable, the rest remains in effect. These Terms plus any order form and the Privacy Policy are the entire agreement. Notices to us: hello@aeolus-cloud.com.
